OepYouis a system, in the form of a mobile application for Android and iOS, developed by EPHEALTH SOLUÇÕES EM TECNOLOGIA DA INFORMAÇÃO LTDA (commonly referred to as Nós), a Brazilian company, headquartered in Florianópolis/SC, which provides access to this application free of charge , with the aim of making informational/educational health content available to the population, allowing the monitoring of health history and facilitating contact with the health team.

The terms of use and privacy policy presented here govern the use of epYou. The user (commonly referred to as You) must carefully read this document before using the services. By registering, accessing and using epYou in any way, including browsing, viewing, downloading, generating, receiving and transmitting any data, information or messages to or from epYou, you indicate your agreement, on your behalf, to all the rules described in this document.

If you do not agree with the general conditions of use presented in this document, do not use the services or the epYou application.

EPHEALTH's rules of use may be updated or changed at any time. Any changes to this document will be presented to the user, who must comply with the new Conditions of Use in order to continue using the Services.

1. ACCESS TO SERVICES

1.1. Users under 18 years of age must obtain the express consent of their parents, guardians or legal representatives to use the Services, in accordance with the provisions of the EPHEALTH Terms of Use and Privacy Policy.

2. REGISTRATION PROCESS

2.1. When You register, You agree to provide true, correct, current and complete information as requested in the registration format made available to You through the Application.

2.2. By registering to use epYou, you expressly declare that you have not received any type of advantage, incentive or anything similar, nor promise of these in return for using the application.

2.3. By registering to use epYou, you expressly declare that you have chosen to use the application voluntarily, in order to view content, monitor your health history and allow contact with the health team.

3. CHANGES TO THE SERVICES OR THE APPLICATION

3.1. We may change, suspend, terminate or discontinue any aspect of epYou at any time, including availability of any Service, information, features or functionality accessible through epYou. We may also impose limitations on certain features, functionality or services or restrict Your access to parts or all of epYou without prior notice and without this implying any liability on Us for any loss You may suffer.

3.2. Any improvements or additions to the Application will be subject to these General Conditions, unless We expressly state otherwise. We may introduce new specific sets of terms and conditions for specific Services, as appropriate, or amend existing specific terms and conditions.

3.3. We reserve the right to control, change the appearance, development and operations of epYou at Our sole discretion, as well as establish and change procedures for Your contacting Us, without notice.

4. THE USE OF THE APPLICATION

4.1. The purpose of epYou is to disseminate educational and informative material on health, allow the monitoring of health history and enable the exchange of information and messages with your health team.

4.2. You expressly declare, for all purposes, that all data that will be sent through epYou are true and have been voluntarily provided by the people who forwarded them, responding to the authorities in the form of civil and criminal law in case of presenting false information.

5. ACCEPTABLE USE POLICY

5.1. You agree not to:

• use epYou or any Content therein for any unlawful purpose;

• knowingly make available through epYou or upload files, data or any other materials not owned or licensed to You;

• make available through epYou or upload files or other data or materials that You know contain viruses, bugs, corrupted data or other harmful items;

• interfere with the normal functioning of epYou;

• interfere with the use and access of other parts of epYou; It is

• publish, post, distribute or disseminate defamatory, infringing, obscene, indecent or unlawful material or information through our epYou.

5.2. We reserve the right to immediately suspend or block Your access to epYou and to remove any information or data that we consider to be a violation of any of these General Conditions of Use, without prior notice and/or to make said information available when requested by public bodies or by order judicial.

6. PRIVACY OF COLLECTED DATA

6.1. EPHEALTH is concerned with maintaining all personal data sent through epYou and kept in our servers in absolute secrecy, so that no personal information is disclosed.

6.2. The personal data collected through epYou may include name, photo, email account, cell phone, identification data and health data filled in by the team responsible for the service and are protected by legislation, in particular by Law nº 12.527/2011, which prohibits the disclosure of personal information, even contained in public records.

6.3. EPHEALTH undertakes not to use the personal data provided by citizens for marketing purposes without their prior consent. Please note that consent is not provided by agreeing to this Privacy Policy.

6.4. The purpose of collecting and storing data entered via epYou is solely to provide our services and to carry out the necessary acts resulting therefrom.

6.5 The data stored through epYou may, however, be used for statistical purposes, which will occur through the use of an anonymous data set with due preservation of the confidentiality of the personal information contained in the data provided, being strictly forbidden the disclosure of any personal and individualized information.

6.6. EPHEALTH adopts all appropriate technical and organizational security measures to protect your data. However, you must be fully aware that no security system offers full guarantees, so that EPHEALTH is not responsible for data leaks, when proven to have occurred in a criminal manner, by third parties outside our staff. .

6.7. You have the right to access your data, always observing the legal limitations. You also have the right to object to the processing of your personal data and to rectify the processed data if you deem it important. If you wish to exercise your right of access to your personal data, to object to the treatment given to them or to request their rectification, please contact us at info@ephealth.com.br.

6.8.The right guaranteed to You in item 6.7 is extended and guaranteed to every citizen whose data is stored on epYou.

7. LINKS TO OTHER WEBSITES

7.1. The content of any websites that You access from EPHEALTH are completely outside Our control, and access to and permanence on such sites will be at Your own risk and expense. The inclusion of these links on epYou does not imply Our endorsement of any products, services, content, information or materials offered by, or accessible to You on, third party websites. We do not represent or warrant any third party websites that You may access through EPHEALTH. We cannot accept any responsibility or assume any liability with respect to any material contained on any third party website. Any opinions or recommendations expressed on such other third party websites are solely those of the independent providers and are not the opinions or recommendations of EPHEALTH.

7.2. All copyrights and trademarks accessible through links on epYou are owned by the respective owners of the websites or their licensors.

8. INTELLECTUAL PROPERTY

8.1. The Application, the Services, their structure and all the functionalities contained therein, all information, data, texts, images and graphics and all components used in epYou are protected by copyright and other intellectual property rights. You acknowledge that EPHEALTH owns all right, title and interest in and to the Content and that You will not, through use of the Application, acquire any proprietary rights therein.

8.2. We own all data arising from Our operation and You must not object to any use of such data by Us.

8.3. The license to use epYou is granted on a non-exclusive, non-transferable, non-sublicensable basis and is revocable at any time in respect of any and all Content provided to You for exclusive use in processing internal systems. EPHEALTH reserves any and all rights over its trademarks, copyrights, and other intellectual property rights, available in Our system, and its use is prohibited without Our express authorization, under penalty of constituting civil and criminal offenses.

9. TERMINATION

9.1. EPHEALTH retains the right to change these General Conditions and your access to epYou or any Services at any time, for any reason, without prior notice.

9.2. You have the right to disagree with these General Conditions of Use or their future amendments, however, you must stop accessing epYou and all the Services for any reason, without prior notice.

10. APPLICABLE LAW

10.1 This Term of Use and all relationships arising from it are subject to the laws of the Federative Republic of Brazil, with the jurisdiction of the Judicial District of the Capital of the state of Santa Catarina being elected to resolve any controversy arising from this instrument.
